On first I agree.
For second, I used to believe that you will be charged even for undelivered messages as they are sent from your mobile. Delivered or not delivered does not matter. But I will confirm this tomorrow and shall tell you.
Also, you should contact personally some Zonal office, give a written application, get is signed by official their , have a photocopy with you. It is mentioned that now Telecom company should settle any dispute in maximum 7 days , if they fail then you can go to consumer court.
